Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lumina platform, including the website at www.wearelumina.co, all associated content, features, and services (collectively, the "Platform").

The Platform is operated by WeareLumina Inc. ("Lumina", "we", "us", or "our").

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

If you are under 18, your parent or carer must review and agree to these Terms on your behalf before you use the Platform.

Lumina is an online learning platform that delivers structured courses across seven learning pillars. The Platform provides:

• Pre-recorded video, text, and multimedia learning content
• An AI-powered tutor (the "AI Tutor") that answers questions and provides learning guidance
• Task submission at the end of each lesson, including text responses and image uploads
• Progress tracking and badge awards across all learning pillars

Lumina is a supplementary learning platform. It does not replace formal education, and completion of Lumina courses does not confer any formal academic qualification or industry-recognised certification.

The Platform is designed for learners aged 14–24. To use the Platform, you must:

• Be at least 14 years of age
• Have the consent of a parent or carer if you are under 18
• Provide accurate and complete information when creating an account
• Not have been previously suspended or removed from the Platform

If you are accessing the Platform through a partner institution (such as a school, college, or organisation), your access may be subject to additional terms set by that institution.

To access the Platform, you must create an account or be enrolled by a partner institution. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying Lumina immediately if you become aware of any unauthorised use of your account

You must not share your account with others or create multiple accounts. Lumina reserves the right to suspend or terminate any account that we reasonably believe has been compromised or is being misused.

You agree to use the Platform responsibly and in accordance with these Terms. You must not:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Submit, upload, or transmit any content that is offensive, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Attempt to manipulate, bypass, or misuse the AI Tutor, including attempting to extract harmful, inappropriate, or off-topic content
• Share personal, sensitive, or identifying information about yourself or others through the Platform, including in AI Tutor conversations or task submissions
• Attempt to access areas of the Platform that are not intended for your use, or interfere with the operation of the Platform
• Use automated tools, bots, scrapers, or other means to access the Platform without our written consent
• Copy, reproduce, distribute, or create derivative works from any content on the Platform without our prior written permission
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Lumina reserves the right to investigate any suspected breach of these Terms and to take appropriate action, including suspending or terminating your account.

The Platform includes an AI-powered tutor that responds to questions and provides learning guidance. By using the AI Tutor, you acknowledge and agree that:

• The AI Tutor generates responses using artificial intelligence and its responses may not always be accurate, complete, or up to date
• The AI Tutor is designed to support learning within the context of Lumina's curriculum and does not provide personal advice, medical guidance, legal counsel, or financial advice
• Your inputs to the AI Tutor are transmitted to a third-party AI provider for processing (see our Privacy Policy for details)
• You should not rely solely on AI Tutor responses for any important decision
• You should not share personal, sensitive, or identifying information in AI Tutor conversations

Lumina monitors the AI Tutor for safety and appropriateness and may review interactions where a safeguarding concern is raised or suspected.

Lumina content

All content on the Platform — including but not limited to videos, text, images, graphics, course materials, branding, logos, and software — is owned by or licensed to Lumina and is protected by copyright, trademark, and other intellectual property laws.

You may access and use Lumina content solely for your personal, non-commercial learning purposes. You must not copy, reproduce, distribute, modify, publicly display, or create derivative works from any Lumina content without our prior written permission.

Your content

When you submit tasks, text responses, image uploads, or other content through the Platform ("User Content"), you retain ownership of your User Content. However, by submitting User Content, you grant Lumina a non-exclusive, worldwide, royalty-free licence to use, store, and process your User Content for the purposes of operating and improving the Platform.

You are responsible for ensuring that your User Content does not infringe the intellectual property rights of any third party and does not contain any material that is unlawful, harmful, or inappropriate.

As you progress through courses, you may earn badges that reflect your learning journey on the Platform. These badges are issued by Lumina and represent completion of specific lessons or milestones within the Platform.

Lumina badges are not formal qualifications, industry-recognised certifications, or academic credentials. They should not be presented or relied upon as such.

Access to the Platform may be free or subject to fees depending on the plan or arrangement in place. Where fees apply:

• Pricing and payment terms will be clearly displayed before you are required to pay
• All fees are stated in the currency specified at the point of purchase and are inclusive of applicable taxes unless otherwise stated
• Payments are processed through our third-party payment provider and are subject to their terms and conditions
• Refunds are handled in accordance with applicable consumer protection law and any refund policy displayed on the Platform at the time of purchase

If you access the Platform through a partner institution, the institution may be responsible for fees on your behalf. In such cases, the payment terms agreed between Lumina and the institution apply.

Where a partner institution (such as a school, college, or organisation) enrols learners on the Platform, the institution is responsible for:

• Obtaining any necessary consent from learners and, where applicable, their parents or carers
• Ensuring learners are aware of these Terms and the Platform's policies
• Managing learner access and supporting safeguarding within their own setting

Lumina may enter into separate agreements with partner institutions that supplement these Terms. Where such agreements exist, they take priority over these Terms to the extent of any conflict.

Lumina collects and processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use, store, and protect your personal data are set out in our Privacy Policy, which forms part of these Terms.

By using the Platform, you acknowledge that you have read and understood the Lumina Privacy Policy.

Lumina aims to keep the Platform available at all times but does not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, update, or discontinue any part of the Platform at any time without prior notice. Where changes are significant, we will make reasonable efforts to inform users in advance.

To the fullest extent permitted by law:

• The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• Lumina does not warrant that the Platform will be error-free, uninterrupted, or free of viruses or other harmful components
• Lumina does not warrant the accuracy, completeness, or reliability of any content on the Platform, including AI Tutor responses
• Lumina shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

If you are a consumer, you have legal rights in relation to services that are not performed with reasonable care and skill. Nothing in these Terms affects those legal rights.

You agree to indemnify and hold harmless Lumina, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Platform
• Your breach of these Terms
• Any User Content you submit through the Platform
• Your violation of any applicable law or regulation

Lumina may suspend or terminate your access to the Platform at any time if:

• You breach these Terms or any applicable policy
• We reasonably believe your account has been compromised
• Your conduct poses a risk to the safety of other users or the integrity of the Platform
• We are required to do so by law or regulation

Where possible, we will provide notice before suspending or terminating your account and give you an opportunity to resolve the issue. However, Lumina reserves the right to act immediately where the safety of users or the Platform is at risk.

You may close your account at any time by contacting us at info@wearelumina.co. Upon termination, your right to access the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will continue to apply.

The Platform may contain links to external websites or integrate with third-party services (including the AI provider that powers the AI Tutor). Lumina is not responsible for the content, privacy practices, or terms of any third-party service.

Your use of any third-party service is at your own risk and subject to that service's own terms and conditions.

Lumina may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes:

• The updated Terms will be posted on the Platform with a revised "Last updated" date
• Where changes are material, we will notify you by email or through the Platform before they take effect
• Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the changes

If you do not agree with the updated Terms, you should stop using the Platform and close your account.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have the right to bring proceedings in the courts of the country in which you are resident, and nothing in these Terms affects your statutory rights as a consumer.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Lumina in relation to your use of the Platform. They supersede all prior agreements, representations, and understandings relating to the same subject matter.
